Zimmer Biomet is the world’s second-largest manufacturer of medical devices. Each year it sells at least 1 million artificial elbows, foot, ankle, hip, shoulder and knee implants. This company has at least $4.5 billion in sales each and every year. Our Implant Injury Attorneys at Carabin Shaw are holding them to account right now for their defective shoulder implants.
On December 20th, Zimmer-Biomet issued an FDA mandated Class I level recall of one of its most used shoulder implant bio-medical devices, the “Comprehensive Reverse Shoulder.” This particular device literally reverses the normal human anatomy of a person’s shoulder. It puts the shoulder ball on the shoulder blade and shoulder socket on the upper arm. This allows the deltoid muscle to use and control the person’s arm.
The Zimmer-Biomet shoulder implant was used in some of the most severely affected patients. Its use included those who had a previous failed traditional shoulder replacement or patients who had developed arthopathy, shoulder arthritis.
The recall was mandated by the FDA after the Zimmer-Biomet shoulder implant was discovered to suffer fractures at a higher rate than expected or listed in its literature. Such fractures may cause severe pain, device breakage, shoulder separation, device failure, need for replacement surgery, a shoulder infection or even the injured person’s death in extreme cases.
According to the FDA, it issues Class I recalls for bio-medical devices which have a “reasonable probability” of causing a “serious adverse health consequence” or “death.”
However, in issuing the recall, Zimmer-Biomet only notified hospital staff, hospital administrators and individual doctors of the dangers of this particular bio-medical device. No recall paperwork was sent to or issued to patients and doctors were actually instructed that was unnecessary to do any increased patient monitoring.
Additionally Zimmer-Biomet had knowledge of the actual fracture potential for the devices as soon as 2010, when they initiated a prior product recall on the same actual product. Despite this, Zimmer-Biomet kept selling these actually defective shoulder implants for several years afterwards. Our Implant Injury Attorneys at Carabin Shaw will and are making them pay what they morally and legally owe to the people who got injured by this particular defective bio-medical implant.
Based on Zimmer’s sale of a dangerous, legally defective, product, and its failure to issue an adequate warning to patients about the actual risk associated with using this product, they are legally liable to those injured by their product. Zimmer-Biomet Implant lawyers, including ours at Carabin Shaw, are currently aiding those with this particular defective shoulder implants make claims and file lawsuits.
