Commercial Drivers and DWI

Those who hold a Commercial Driver’s License (“CDL”) know that even routine traffic violations can result in license suspensions, subsequently affecting their livelihood. While the criminal process is the same for both CDL holders and non-CDL holders alike, the administrative and license consequences are much more difficult for commercial drivers. Commercial drivers will have their license suspended for an entire year under the following circumstances:
- First conviction of DWI alcohol
- BAC of .04 or higher while operating a commercial vehicle
- BAC of .08 or higher while operating a personal vehicle
- Refusal to submit to a BAC test
