Was my Injury Preventable?

Athletes who are involved in sports, particularly fast-paced ones, are uniquely vulnerable to suffering injury, short term, from concussions. These concussion type injuries can also cause long-term brain damage. Sadly, those who could prevent such tragic, and sometimes permanent, injuries related to concussions frequently fail to act in a reasonable way. They thus do not protect their most important responsibilities, the athletes. If you or a family member has suffered a concussion because they were not protected by both rules and good equipment, one of our San Antonio Concussion Injury Lawyers can get you the help that you need. It is not your fault.

When the people responsible for high school and college athletics do not protect those in their care, they must be held to account for their failures. They need to pay for their lack of care. If and when they do, they may well act more reasonably in the future. That is the hope anyway. When they must be held liable, that is where we come in. Our attorneys have years of experience teaching negligent people expensive lessons in what not to do in the future in a similar situation. We can do that for you. Carabin Shaw can get you your best chance at the maximum recovery allowed by law. A lot of information about the dangers of injuries due to concussions has been available for many decades. Despite this knowledge of the very real dangers, individuals and sports organizations have acted regularly against the best interest of these very athletes in many ways.

Some instances of authorities increasing the risks of suffering concussions include:

  • Failure to warn athletes and their family of concussions symptoms and risks
  • Failure to manufacture and/or issue sufficient and proper equipment for safety
  • Utilizing incorrect policies regarding return-to-play

A concussion can be categorized scientifically as a brain injury of the traumatic type. Despite this, many individuals and sports organizations have failed to take it as seriously as it deserves. If any athlete were to suffer from a heart attack, a coach or sports trainer would never seriously consider permitting a post attack heart-attack victim to participate in any sport without a full and satisfactory recovery. Despite this, when the brain gets injured, many people associated with sports do not take it in a seriously similarly way. The Concussion Injury Attorneys in San Antonio at Carabin Shaw do indeed take head injuries and concussions seriously. We understand that coaches and teams want to minimize them. If they do, we are in a position to help you make them pay for this mistake for all that the law allows. Give us a call and get us started working for your recovery.

The Long-Term Risks That Can be Associated With a Concussion

Athletes who suffer from the syndrome known as “post-concussion syndrome” can experience concussion symptoms for months following an impact which causes a concussion. The athlete who is concussed may well experience such symptoms as chronic headaches, anxiety and/or depression.

Concussions have been linked to brain damage, a long-term condition and progressive and ongoing neurodegenerative diseases. Namely, they have increased rates of cognitive impairment, dementia, Alzheimer’s disease, most sadly and seriously, “Chronic Traumatic Encephalopathy” (CTE). CTE can result if and when a particular protein builds up to toxic levels in the brain. Then, it kills brain cells, and can eventually lead to dementia and/or severe depression. It can take several years for any symptoms to manifest themselves and the onset of this syndrome may resemble Parkinson’s disease in its symptoms. Some people may well experience epileptic seizures post trauma if they have this condition. If your family member, or you, have any history of these symptoms and any history of impacts in athletic competition, you should call the Concussion Injury Attorneys in San Antonio at Carabin Shaw. We offer a free consultation to go over the specifics of your situation with one of our attorneys to determine if you have rights to file a claim and/or a lawsuit to collect damages rightfully owed to you.
