Legionnaires Disease is a virulent, specific type of bacterial pneumonia that has been known to happen to individuals who get exposed to legionella bacteria. This bacterium can be present in contaminated water supplies. Legionnaires Disease is not known to be transmitted from one person to another. Instead, it is usually only spread to persons in direct contact with a contamination source, usually water. Among the common sources which can cause exposure to legionella bacteria are hot tubs, swimming pools, steam rooms, commercial air conditioning, and exposure while showering.
Some of the common symptoms associated with Legionnaires Disease are aches and pains, headaches, chills, fevers as well as specific and/or general organ failures. If you or a loved one have experienced any of these symptoms you really must take them to a doctor or other medical professional for an immediate physical examination. If Legionnaires Disease is not quickly and properly treated, these health complications can get much, much worse. Legionnaires Disease can even prove fatal if the infected individual does not get proper medical treatment.
When and if you get Legionnaires Disease, you really have suffered poisoning.
Recovery After You Contract Legionnaires DiseaseMaking an identification of the source of the contaminated water is the key to making your negligence claim successful. Unfortunately, this job can be difficult. Locating the actual source of contaminated water is frequently a difficult task because it requires people to figure out the actual period of time during which they were actually exposed to the contaminated water and also to identify every and each source of water which potentially could have exposed the person to the harmful legionella bacteria. The potentially contaminated water sources need to be tested to figure out if they are actually the source of any contamination. After the source of the contamination is actually identified, a lawsuit can be filed against a property manager and/or owner if there is reasonable proof that one of them was negligent in testing for the legionella bacteria and/or cleaning the infected area.
After establishing all of this, your Legionnaires Disease Attorneys can file a lawsuit. In that lawsuit recovery is only available upon and after a showing of negligence. Good admissible evidence is needed. A negligence lawsuit will only be successful if the party who suffered injury can prove that there existed a duty for the defendant to protect all injured parties. The plaintiff must also prove that this duty was breached, that this breach was the actual proximate cause of any injuries, and that the injured party suffered damages that can be proven to be a result of the breach.
