The M2A Magnum Hip Replacement SystemA huge group of claims and lawsuits against Biomet, every one of which allege serious damages resulting from the company’s M2a Magnum metal to metal Hip Replacement System, were, by Court order, consolidated into what is known as a “multidistrict” litigation case in the United States District Court for the Northern District of Indiana in or about autumn 2012.
The 2001 Dated Recall of Hip Implants Allegedly Containing the Components Which are Potentially DefectiveMore than 10 years ago, well before the M2a Magnum Hip System at issue was actually approved by the FDA, Biomet was in Court dealing with legal problems resulting from other of its hip implant products: Biomet voluntarily recalled its hip prostheses which included potentially defective components, zirconia ceramic thigh bone (femoral) heads.
Following up on good quality reports detailing broken hip implant components, the Federal Food and Drug Administration (FDA) mandated a recall, in 2001, of a certain specific components of the hip-implants: thigh bone (femoral) heads manufactured by the French company St. Gobain Desmarquest. Eight different American orthopedic companies, which included Biomet, were found using the allegedly defective components as part of their total replacement hips then. Recall Involving Femoral Heads From Zirconia CeramicIn 2001 St. Gobain Desmarquest recalled its femoral heads made of zirconia ceramic. This part was included as a component in several hip implant brands. The recall was based upon reports that these femoral heads sometimes fractured between 13 and 27 months after they were implanted. As this rate was unacceptably high rate, recall was mandated. Most replacement hips last 15 years, 20 years or longer.
In response to this manufacturer’s femoral-head recall, and after a number of lawsuits by several different law firms, such as the San Antonio Hip Replacement Lawyers at Carabin Shaw, eight different American manufacturers who used these allegedly faulty devices as component parts of their hip replacement systems felt obligated to issue voluntary product recalls of the inventories of these femoral heads which were not yet implanted. Biomet was one of those companies. The others included DePuy Orthopedics, Stryker Orthopedics, Osteoimplant Technology, Inc., Encore Orthopedics, Apex Surgical and Smith & Nephew.
However, this recall only covered unimplanted hip components. Therefore it is very possible that some patients got the part with the defect before it was recalled off the market.
