What Actually is a Biomet M2a-38?The Biomet M2a-38 is a replacement hip of metal-on-metal design which is made from cobalt and chromium. This particular design was orginally planned as a replacement for other types of designs of artificial hips because it was supposed to last longer and give the patients a wider range of motion and more flexibility in the hip.
What Exactly is the Problem?The entire concept of Metal-on-metal designs for hip implants has become controversial after a number of studies discovered that these replacement hips had risks, unique to this design, which were in addition to the already existing risks of other types of hip implants. The basic problem is the grinding together of the metal pieces which happens every time a patient moves. This metallic friction may generate tiny particles of cobalt and chromium which can “flake off” and build up in the patient’s hip joint.
The Cobalt debris is made up of ions which are soluble in water and can, and do, leech into the patient’s bloodstream and cause a metal toxicity called metallosis. Metal bits or debris present in the patient’s hip will also cause soft tissue growths, bone death, inflammation, swelling and pain, and other bad side effects which can contribute to the implant’s premature failure. When these kinds of complications happen, almost all patients need surgical revision.
Class Action Information About Biomet Hip ImplantsCarabin Shaw’s Biomet Hip Attorneys in San Antonio are currently filing these lawsuits. As stated above, Biomet Inc. has agreed to pay out $56 million for compensation and fees to the attorneys to settle hundreds of pending lawsuits which involve the Biomet M2a-38 and M2a-Magnum metal-on-metal designed and built hip replacements. This settlement, basically, would make a payment of about $200,000 for each plaintiff who qualifies, although larger awards may be approved in certain cases.
Additionally, there are lawsuits which are not part of any class action against Biomet, Inc. Instead, at least 1,000 individual damages lawsuits have been transferred to a federal Multi-District Litigation (MDL No. 2391) panel in the U.S. District Court for the Northern District of Indiana for centralized discovery and pre-trial handling.
