How Your Attorney Can Help with the Auto Accident Insurance Claims Process
If you have gotten an unacceptable settlement offer from your insurance company after an auto accident, give Carabin Shaw a call. We have over 20 years of experience dealing with auto insurance companies that will not pay. We have made them regret this. We can make them regret it in your case.
The Demand LetterThe first step is a new “demand” letter. Our experienced Corpus Christi Auto Accident Attorneys will analyze the facts of your case, check the relevant law and see what amounts prior injuries similar to yours were worth. Armed with this information, our Corpus Christi Accident Team will put together all of your medical bills, medical reports, factual evaluation and relevant law and send them to the insurance company’s representative. In that package, we will, in close consultation with you, ask for a realistic dollar amount to settle the case.
Sometimes, the insurer will pay this amount. If they do, we take our fee as a percentage of this and you go home with a fair amount of money. If they don’t, the negotiation process begins.
We, With Your Close Cooperation, Negotiate With the Insurance Company RepresentativeWhat happens next is a negotiation process. They offer more. We then, with your help, send a fair offer which is less than we originally asked for. We take this process into account when we make the first demand upon the insurer. They may take this offer or they may reject it. If they counter offer, we can make another offer, and so on. We, with your help, keep doing this until the case settles or we both decide that the process has run its course and it is time to get ready for trial. IF we have to go to trial, we have and will fight in Court for people just like you.
If the Insurer Denys Your ClaimIf your claim gets denied in part or in whole, there might be reasonable and legitimate reasons to do so. Most of these reasons relate to the limitation of liability sections contained in your insurance policy. You should check the insurance company’s denial letter against your policy’s specific provisions to see whether the coverage denial, in whole or in part, makes sense to you or it doesn’t. You must then decide whether to sue them over this claim or part of a claim. In the end, only you can decide whether to file a lawsuit or not. But whatever you do decide, do not wait very long to get it done. If you wait for too much time, you may well lose your rights to file suit in court to get the recovery you really deserve. Each state has a time limit for getting a lawsuit filed in court. (This is called a “statute of limitations.”) In many states, this statute of limitations is 2 or 3 years for personal injury claims, but it could be a shorter or longer period of time. Realistically, only an attorney can give you good advice on your specific situation. If nothing else, you should consult with a good lawyer to see how long you have before you lose your rights.
