The Demand LetterThe first step is a new “demand” letter. If the Insurer Denys Your ClaimIf your claim gets denied in part or in whole, there might be reasonable and legitimate reasons to do so. Most of these reasons relate to the limitation of liability sections contained in your insurance policy. You should check the insurance company’s denial letter against your policy’s specific provisions to see whether the coverage denial, in whole or in part, makes sense to you or it doesn’t. You must then decide whether to sue them over this claim or part of a claim. In the end, only you can decide whether to file a lawsuit or not. But whatever you do decide, do not wait very long to get it done. If you wait for too much time, you may well lose your rights to file suit in court to get the recovery you really deserve. Each state has a time limit for getting a lawsuit filed in court.
