Shopping Injuries in Texas: What You Need to Know
Holiday cheer comes with crowded malls and stores, stressed-out and overworked employees, and icy weather — the perfect storm for a shopping injury to occur.

Suing for a Shopping Injury
In Texas, stores are legally required to maintain reasonably safe environments that are free from hazards. This includes regular maintenance and response to accidents, such as:
- Replacing burnt-out light bulbs,
- Cleaning up spills promptly,
- Removing fallen objects in walkways,
- Properly training employees operating equipment around customers,
- And fixing broken railings/stairs.
You can file a personal injury claim against a store for an injury that occurred on their property if you can prove:
- The store owner knew (or should have known) about a dangerous condition on their property.
- The store owner didn’t inspect the store for dangers or provide adequate maintenance.
- The dangerous condition occurred regularly or existed for so long that the store owner had constructive knowledge of it.
- If the dangerous condition didn’t exist, you wouldn’t have been injured.
- The dangerous condition directly caused your injury.
- You suffered losses as a result.
