The Psychological Effects of Burn Injuries and How It Affects Your Injury Claim
One of the most devastating injuries a person can face is a severe burn injury.
You can suffer a severe burn injury in an auto accident (even when no fire is present), at work, school, or senior care facilities across Texas. While you can and likely will fully recover from a minor burn, severe burns can impact the rest of your life both physically and mentally.
The Psychological Effects of Burn Injuries
A burn injury is one of the most painful types of injury you can experience. Even “well-managed” pain can persist, scarring can lead to physical disfigurement, and mobility can even be reduced from a burn injury. This can affect your ability to return to work or take part in activities you enjoy.
The effects of this take a huge toll on your mind. Severe burn victims often exhibit:
- Panic Attacks,
- Depression,
- Loss of Sleep,
- Increased Pain/Itching,
- Impacted Self-Image,
- Damaged Personal Relationships,
- Decreased Enjoyment,
- Loss of Interest in Daily Life,
- And Increase the Effects of Pre-existing Medical Conditions.
How Psychological Effects Impact Your Claim
Mental suffering after an injury is taken into account when determining the value of your claim.
In Texas, mental anguish is often calculated using the multiplier method. Essentially, your economic damages will be calculated (i.e., medical bills, lost wages, property damage) and multiplied by 1.5 to 5.0, depending on how severe your injuries are.
There is no “standard” multiplier that can be applied broadly across all cases. Pain and suffering are subjective and unique to each person, and how large the multiplier should be is often determined by the impact the injury has on the victim’s life. Factors that contribute to a higher multiplier often include:
- Your age,
- The severity of your injury,
- Pre-existing conditions,
- Medical prognosis,
- How much it has impacted your quality of life,
- And any long-term implications of the injury.
High multipliers are often challenged by insurance companies as an attempt to artificially inflate your claim (claim that you are suffering more than you are for more money). Even though the psychological impacts of a burn injury are legitimate and carefully calculated, they may still be challenged by the responsible party. Hiring an attorney is essential to ensure you are fairly compensated after a burn injury.
