Police Can Ask You to Step out of Your Car
Police are allowed to ask you and your passengers to step out of the car during a traffic stop in Seguin. You should never attempt to exit your vehicle unless the officer tells you to do so. Police Can Perform a Pat Down for Weapons
If an officer has a reason to suspect you have a weapon, they are allowed to perform a pat down of your outer clothing during a traffic stop in Seguin. They are also allowed to take the weapon from you. They may also search areas of your vehicle that can be reached from the driver’s seat that may be concealing a weapon if they suspect you have one, like the glove box or under the seat.
Police Need a Warrant to Search Your Phone
Information on your phone is private and is treated similarly to your house when it comes to search and seizure laws. If an officer asks to see your phone in a Seguin traffic stop, you don’t have to show it to them. Also, information on your phone’s lock screen may not be used as evidence against you either — 4th Amendment laws also protect it.
