According to the BSCO report, the accident happened at Dove Canyon Access Road near Loop 1604 in West Bexar County on June 3rd. Raul Pena was struck by what was believed to be a Toyota Tacoma after he moved his son out of the path of the vehicle. He later succumbed to his injuries. The truck was last seen turning down Marbach Road and then Pue Road. It is believed to have damage to the grill and should be missing the letters “T” and “O,” leaving the letters “YOTA.” Falcon Wolf, Big Wolf Creek, Pue Road, Sunset Place, or Lynwood Village neighborhoods are suspected to be where the vehicle is.

Compensation for Wrongful Death After a Hit-and-Run Accident in Texas

Fatal hit-and-run accidents like this are growing more common — data analyzed by Value Penguin found that such accidents increased by 89.4% from 2012 to 2021.

If you’ve lost a family member in a hit-and-run accident, getting compensation can be challenging, but with the help of an attorney, it is not impossible. Where compensation will come from will depend on whether the driver is caught.

If the Driver is Caught

You can sue the driver for civil damages even if they are facing a criminal trial for fleeing the scene. Compensation will come from their insurance, and an attorney will negotiate a fair settlement value (or take the case to court if necessary).

If the Driver is Not Caught (Or Has No Insurance)

Compensation for your family’s loss can come from PIP or Uninsured/Underinsured Motorist Coverage if the driver is not caught (or has no insurance). However, these coverage types are optional in Texas, so many people do not have them. Home insurance can also cover wrongful death in certain cases. If you’re unsure about your coverage, an attorney can help you go over it.
