Defective Product Injuries At Work in San Antonio

Even the most careful employees can be seriously injured at work if they are working with defective equipment.

While construction and warehousing have a significant portion of all recorded injuries in Texas workplaces, any employee can be hurt in any environment. If you were hurt at work because of defective equipment, you could be entitled to compensation for your injuries.

What Types of Defective Equipment Can Hurt Employees?

Most people think of cranes and bulldozers when considering dangerous equipment. While construction and manufacturing equipment is extremely dangerous when defective, any kind of defective equipment can put an employee at risk, such as:

  • Defective railing/stairs,
  • Defective ovens,
  • Defective ladders,
  • Defective lawn equipment,
  • Defective electrical equipment,
  • Defective vehicles,
  • Defective kitchen equipment,
  • And defective safety gear.

Any equipment that doesn’t function properly, doesn’t have sufficient warning labels, or has worn significantly due to excessive use is defective and unsafe for employee use.

What Kinds of Injuries Does Defective Equipment Cause?

The type and severity of an injury will vary based on the circumstances of the accident. Some common workplace injuries due to defective equipment include things like:

  • Lacerations,
  • Burns,
  • Inhalation Injuries,
  • TBI,
  • Fractures,
  • Back/Spinal Cord Injuries,
  • Severe Bruising,
  • Hearing Loss,
  • Vision Loss,
  • And Nerve Damage.

Is My Employer Responsible for an Injury Caused by Defective Equipment?

An employer can be responsible for an injury caused by defective equipment, but other parties may bear fault as well.

Workplace injuries caused by defective equipment are typically divided into three categories:

  • Manufacturing Defects: When workplace equipment is manufactured with a defect that makes it unsafe. The manufacturing company can bear responsibility if the original design is safe, but the manufacturer fails to follow the safe design, causing an injury.
  • Design Defects: These defects happen during the design process. The company that designed the product can bear responsibility if an alternative design exists that is safer but performs the same function and was not used, causing an injury.
  • Marketing Defects: If the design and construction of the product were safe but failed to provide adequate safety warnings regarding the inherent danger of the product. This is considered a marketing defect and can cause the company to bear fault if the employee was using it according to manufacturer instructions.

However, workplace equipment is often worn out due to regular or excessive use. If your employer knew that the equipment was unsafe but failed to replace or fix it, or if your employer failed to properly maintain equipment, they could bear fault for your injury as well.
