Sedan Hits Debris on the Highway, Splits in Half After Striking SUV

According to a KSAT News report, a man tragically lost his life after striking highway debris and losing control of his Sedan last week.

Police reported the accident occurred at around 6 a.m. in the 7200 block of State Highway 151 on Wednesday, July 3rd, on the West Side of San Antonio. A driver of a sedan was traveling westbound when he hit debris in the road, causing him to lose control and travel across the grassy median. He then struck an SUV traveling eastbound, and the impact caused the sedan to split in half. The driver was ejected and pronounced dead at the scene in the ambulance. The report did not say if the driver of the SUV suffered any injuries or if any other vehicles were affected by the crash.

Road debris accidents are more common in the summer months.

Road Debris Accidents in Texas: Who’s Responsible?

Summer months come with hurricanes and increased road construction projects for Texas. Both of these things make road debris far more common, putting drivers at risk.

When a tragic accident like this one happens, many wonder who can be held responsible for debris on the road. Let’s take a look.

How Does Debris Get on the Road?

The most important aspect of these cases is how the debris got on the road. For example, road debris can come from:

  • Unsecured loads falling from trucks,
  • Construction companies dropping debris,
  • Tree limbs falling from trees onto the roadway,
  • Or tire treads falling from big rigs onto the highway.

Determining where the debris came from can be difficult, but once that is done, the next step is to determine liability.

Who Can Be Responsible For Road Debris Accidents?

Many parties can be held responsible for a road debris accident, including:

  • Other drivers,
  • Construction companies,
  • Government entities,
  • Shipping companies,
  • And trucking companies.

If the person or company responsible for the debris was negligent in some way, they can be held responsible for the accident it caused. A few examples of negligence would include things like:

  • A driver did not properly secure the wooden planks in their truck bed, and they hit your vehicle,
  • A construction company carelessly let rocks spill onto the highway, and you crashed as a result,
  • A state government entity was aware that tree limbs had fallen into the road but didn’t clear them, resulting in an accident.

Road debris is especially dangerous to motorcycles and during inclement weather conditions when visibility is low. Oftentimes, drivers and motorcyclists come upon debris suddenly and don’t have time to avoid it, even if they are following safe driving practices.

If you were hurt in an accident because of road debris, you could be entitled to compensation. Talking to an experienced attorney about your case will help you understand your legal options and see if you have grounds for a personal injury claim.
