Texas Accidents on the Rise

On March 14, 2022, the TxDOT reported that 2021 marked the second-deadliest year for Texas roadways, with 4,480 people killed. That is a mere two hundred and twenty-one less than the deadliest year since 1940, reported in 1981. Several thousand of these deaths were caused by the simple but devastating mistakes of not wearing a seatbelt or driving over the posted speed limit. 2021 also saw a 15% increase in fatalities over 2020, with an 18.4% increase in the first half of the year alone. The TxDOT is tracking accidents to determine where roads need to be improved to make our roads safer. However, the primary responsibility for safe roads in Texas lies in the hands of Texas motorists. Commissioner Laura Ryan said, “Driving behavior is the cause, but also one of the most important solutions. This is not blame. These are the facts. We all have a role.” If you or someone you love has been affected by the careless actions of a Texas motorist, you may be entitled to legal compensation. (May 1, 2022) On Monday, April 24, 2022, two 18-wheelers collided with each other on Interstate 10 near downtown San Antonio, as reported by KSAT. The accident occurred while one truck was attempting to change lanes and lost control of the vehicle. It was raining at the time, and the roads were very slick, which seemed to contribute to the accident. The rig swerved, causing it to collide with a nearby 18-wheeler, which then jackknifed across all but one lane of I-10. The cabin then slid off the highway onto the lower level. Police reported that the cabin becoming wedged to the lower level of the highway was what prevented the whole rig from flipping completely over. It remained stuck dangling from the wall. No other vehicles were caught in the accident, and there were surprisingly no injuries reported as of May 1, 2022. The entire incident was captured on the dashcam of a closely following driver, who then shared the video with KSAT news.

Tips for safe driving in inclement weather conditions:

Whether you’re an experienced, confident driver, or brand-new to driving, it’s important to practice safe driving in inclement weather conditions. Even light rain can cause the roads to become very slick with lingering oil and dirt, greatly increasing the risk of hydroplaning or losing control of your vehicle. Additionally, our beautiful San Antonio hill country has many areas at high risk for flooding on the road. Here are some safe driving techniques you can use to make sure you’re driving safely.

Man stepping over puddle in rain

(May 1, 2022) A man is in critical condition at the hospital after being struck by an intoxicated driver while crossing the street last night, April 31, 2022, as reported by KSAT. Apparently, the man was crossing the street at the 8100 block of Marbach on San Antonio’s West Side, when he was struck by a silver vehicle. He was seriously injured, as reported by the police, and was transported to the hospital in critical condition. However, he was stable as of last night. The driver of the silver vehicle fled the scene and was charged with failure to render aid after he was found near the accident by the police. They also reported that the man appeared to be intoxicated and was also charged with driving while intoxicated.

Early this morning, May 1, 2022, a woman was struck and killed by a vehicle while attempting to cross Interstate 10 on the 9700 block on the West Side. Police reported that a distressed and unclothed woman approached their vehicle while they were parked in a parking lot near an I-10 access road at 1:35 A.M. The officers called for Emergency Medical Services and requested a female officer, but the woman became confrontational when they attempted to render aid. She then fled across the highway when she was fatally struck by an oncoming vehicle, which was unable to avoid her. The driver did not stop to render aid, but no charges are pending at this time.

During assessing a crash that had just happened, the crews onsite got a call about another crash that had just occurred. This crash occurred at around 1 a.m. on a Monday on Highway 151 access road. In this crash, the female driver of the vehicle was driving on Loop 410 when she suddenly could no longer control her car, and it, unfortunately, rolled over. Because her vehicle rolled over, it trapped her inside, and she was unable to escape on her own. When the firefighters arrived and the scene, they managed to cut the woman out of the vehicle. Her injuries sustained in this single-vehicle accident were severe enough to be considered life-threatening. She was immediately brought to University Hospital for medical treatment.

It is frightening and dangerous when a vehicle rolls over, and the driver and passengers involved may sustain devastating injuries. Unfortunately, rollovers are more likely to happen when SUVs and trucks are involved in the accident. Understanding the kinds of automobiles that are most likely to roll over in a crash and how to reduce your chances of getting into a rollover accident can help you make better choices while driving.

According to vehicle safety tests, the Cadillac Escalade and the Chevrolet Tahoe are among the most likely vehicles to roll over. Even so, it is essential to note that any automobile can roll over regardless of make and model under the correct conditions. Those who have sustained injuries in rollover accidents may be entitled to compensation. Rollover crashes can be minimized by taking certain steps.

An accident that led to injuries sustained by two individuals occurred early on a Monday morning on the city’s Southeast Side. The crash happened at roughly 1 a.m. on SE Military Drive near South W.W. White Road. Initially reported, the female driver and one passenger were heading down SE Military when the driver couldn’t control the car, and it rolled over numerous times off the road.

The police stated the driver was able to escape the car. However, the passenger, unfortunately, had to be extracted by firefighters. They were both hastily transported to Brooke Army Medical Center. While the driver is listed as stable, the passenger is unfortunately in a more severe condition.

The injuries and damages sustained can be extremely severe when rollover accidents occur. Not only are you in danger of sustaining injuries, but other vehicles on the road are as well. There are many different types of injuries you could suffer in these types of accidents. Some of these include Head trauma, Brain damage, Soft-tissue injuries like whiplash, Concussions, Spinal cord injury, Paraplegia / Quadriplegia, Amputations, Burns, and Scars from glass or flying debris.

Who is at fault in an auto accident in San Antonio?

Personal Injury and Negligence law varies widely between States. Texas is an “At-Fault” State, as opposed to a “No-Fault” State like Florida or Pennsylvania. This means that any driver who is either completely or at least 50% responsible for an accident must take legal responsibility for it. To recover damages from the responsible party, the plaintiff must prove that the other party is at least 50% responsible for the accident. That is why it is important to call the police, or if the police cannot come to the accident site, to go to the police station and file a report if you have been in an auto accident in San Antonio. Our experienced attorneys at the Law Office of Carabin Shaw have nearly 30 years of experience dealing with big insurance companies here in San Antonio. If you think you have a personal injury claim, it’s important that you contact a reliable firm as soon as possible.
