Wrongful Death in 18-Wheeler Accidents in San Antonio

Far too many people are killed on Texas roads in 18-wheeler accidents.

Texas highways facilitate much of the trade between Mexico and the United States. Many of these highways cut right through San Antonio, and the increased demand for these goods is flooding the highways with 18-wheelers.

When the negligence of a truck driver causes you to lose a family member, Texas law allows you to pursue compensation in the form of a wrongful death claim.

Types of Damages in a Wrongful Death Suit

Monetary compensation won’t replace your loved one. Its intention is to ease the burden you and your family will face as a result of your loss. To this end, compensation includes things like:

  • Medical Expenses,
  • Funeral Expenses,
  • Lost Benefits,
  • Loss of Support,
  • Loss of Companionship,
  • Loss of Affection, Care, Assistance, and Protection,
  • and Punitive Damages (“punishment” damages intended to discourage the perpetrator from harming others with similar behavior).

Every person’s impact is unique. A wrongful death attorney can explain exactly what applies to your case to ensure you don’t miss any compensation.

Who Can Sue for Wrongful Death in San Antonio

The point of a wrongful death suit is to alleviate the burden felt by the close family members of the deceased. Because of this, not just anyone can file a wrongful death claim. In San Antonio, you can file a wrongful death claim if you are:

  • The surviving spouse — Husbands and wives are entitled to bring the suit on their behalf and that of their children if they are still minors.
  • The surviving children — If the deceased is not married or wasn’t survived by a spouse, then their children may bring the wrongful death claim.
  • The surviving parents — If the deceased had no spouse or children, the parents are permitted to bring the claim.

If the deceased had no immediate family, a representative from their estate is permitted to bring the claim and distribute the money to the deceased’s heirs according to their will.
