Shopping Injuries in Texas: What You Need to Know

Holiday cheer comes with crowded malls and stores, stressed-out and overworked employees, and icy weather — the perfect storm for a shopping injury to occur.

Regardless of the strain caused by holiday crowds, businesses are required to keep their premises safe from hazards for their customers. If you’re injured while holiday shopping this year, you may be entitled to compensation.

Common Shopping Injuries

The most common types of injuries people suffer while shopping include:

  1. Slip-and-Fall Injuries — Wet floors, icy walkways, parking lot defects, and debris can all cause serious slip-and-fall injuries. Injuries from slip-and-fall accidents can include things like:
    • Broken Wrists,
    • Spinal Cord Injuries,
    • Head Injuries,
    • Broken Legs,
    • And Severe Bruising.
  2. Shopping Cart Injuries — Shopping carts can severely injure both children and adults, especially since stores have had more employees fulfilling online and curbside shopping orders in stores in recent years. Shopping cart injuries can include things like:
    • Head Injuries,
    • Neck Injuries,
    • Broken Bones,
    • Broken Fingers,
    • And Severe Bruising.
  3. Escalator and Elevator Injuries — Defective escalators and elevators in larger retail stores can cause severe injury. Injuries from escalators and elevators can range from minor sprains to more extreme injuries like:
    • Head Injuries,
    • Spinal Cord Injuries,
    • Crushing Injuries,
    • Laceration,
    • Fractures,
    • And Soft Tissue Injuries.
  4. Overcrowding Injuries — When a store becomes overcrowded with customers or large groups all rush to one part of the store, people can be seriously hurt. Injuries that are caused by overcrowding include:
    • Suffocation,
    • Crushing Injuries,
    • Internal Organ Injuries,
    • Broken Bones,
    • Head Injuries,
    • And Severe Bruising

Suing for a Shopping Injury

In Texas, stores are legally required to maintain reasonably safe environments that are free from hazards. This includes regular maintenance and response to accidents, such as:

  • Replacing burnt-out light bulbs,
  • Cleaning up spills promptly,
  • Removing fallen objects in walkways,
  • Properly training employees operating equipment around customers,
  • And fixing broken railings/stairs.

You can file a personal injury claim against a store for an injury that occurred on their property if you can prove:

  1. The store owner knew (or should have known) about a dangerous condition on their property.
  2. The store owner didn’t inspect the store for dangers or provide adequate maintenance.
  3. The dangerous condition occurred regularly or existed for so long that the store owner had constructive knowledge of it.
  4. If the dangerous condition didn’t exist, you wouldn’t have been injured.
  5. The dangerous condition directly caused your injury.
  6. You suffered losses as a result.
