Uber or Lyft Accident in San Antonio — What You Need to Know
Rideshares are part of everyday life for more and more people as an effective alternative to taxis, public transportation, and driving drunk. Uber specifically runs campaigns to limit drunk driving, offering discounts to encourage safer choices. But accidents happen.
101 people died in Uber-related accidents between 2019 and 2020. A report from the company breaks down these fatalities by type:
- 42% were pedestrians, motorcyclists, and cyclists
- 15% were unbuckled riders
- 13% were unbuckled third-party (not Uber) drivers
- 15% were wrong-way drivers
- 23% were drunk drivers
Half of these fatalities were the result of the most common risky driving behaviors of 2020, which were speeding, drunk driving, and wrong-way driving. While the Uber drivers themselves almost never engage in these behaviors, you can still be seriously hurt in an Uber or other rideshare accident in San Antonio.
Liability in Rideshare Accidents
Depending on who caused the rideshare accident, there are many sources of liability where your compensation could come from after the accident.
- Your Own PIP Insurance — If Lyft or Uber determines your injuries are not covered under their policy.
- Third-Party’s Liability Insurance — If someone other than your Uber caused the accident.
- Uber’s Insurance Policy — If you were in the Uber when the driver caused the accident or if the driver who caused the accident did not carry insurance.
Insurance coverage in rideshare accidents can be complicated — specific scenarios and rules apply when determining who is going to pay for an injury in a rideshare accident.
What to Do Immediately After a Rideshare Accident
The steps you need to take after a rideshare accident and any other car accident are mostly the same. You need to call the police for an accident report and seek immediate medical attention for your injuries. You also need to contact your insurance company and report the accident as soon as possible so that you remember most of the details clearly.
One additional step you should take after an Uber or Lyft accident is reporting it to the company. Your driver should do that for you, but it’s a good idea to file your own report as well.
