18-Wheeler Cargo Spills in San Antonio: What You Need to Know
18-wheeler accidents are some of the scariest accidents you can encounter as a driver and for a good reason. 18-wheelers are incredibly powerful destructive forces when fully loaded and kill hundreds of people in Texas every year.
One of the aspects of 18-wheelers that make them so deadly is their cargo. Cargo that spills onto the road can involve multiple innocent parties in the accident and cause further destruction.
Common Causes of 18-Wheeler Cargo Spills
Cargo commonly spills after an 18-wheeler accident due to:
- Sudden Braking,
- Driver Fatigue,
- Reckless Driving (i.e., taking turns too fast, speeding, distracted driving),
- Potholes and other Road Defects,
- Defective or Poorly Maintain Rigs,
- Improper Loading,
- Overloaded Rigs,
- Inappropriate Rig Size,
- And Imbalanced Loads.
Who’s Responsible for a Cargo Spill?
The FMCSA and OSHA regulations for the loading and transportation of cargo must be strictly adhered to. In the event of an accident, an investigation will be conducted to determine the cause.
If the truck was loaded properly but spilled because of the truck driver’s negligence, then the truck driver and company who hired them would likely bear fault. If the load was improperly secured, the company or inspection teams could be held responsible in addition to the driver.
If another driver caused the big rig to crash, then they would likely bear responsibility for the cargo spill. If a defective part caused or contributed to the severity of the accident, the manufacturing and maintenance companies could bear fault.
As a general rule, the person or persons who caused or contributed to the accident could bear fault.
Types of Claimable Damages in a Cargo Spill Accident
If you were injured in a cargo spill accident, you may be entitled to compensation for damages such as:
- Ambulance Costs,
