40% of vehicle deaths in 2022 were caused by single-vehicle accidents.

Are Single-Vehicle Accidents Always the Driver’s Fault?

Single-vehicle accidents (meaning there was no impact with another vehicle) are almost always caused by driver error. Overcorrection, taking a turn too fast, hitting a curb, drunk driving, etc. However, not all single-vehicle accidents are the driver’s fault.

Let’s take a look at common single-vehicle accident types that are not the driver’s fault and where you can get help if you were injured in a single-vehicle accident that wasn’t your fault in San Antonio.

Single-Vehicle Accidents That Aren’t the Driver’s Fault

Just because you weren’t impacted by another vehicle doesn’t mean an accident was your fault. For example:

Accidents Caused by Defective Vehicles

Some vehicles are poorly designed, making them easier to tip over. Sometimes, defective tires can be placed on your vehicle and cause an unexpected accident. Or maybe you sent your vehicle in for repairs, and it wasn’t done properly or broke something else, leading to a crash.

In all of the above cases, liability most likely lies with another party, like a vehicle manufacturer, tire shop, or repair shop.

Accidents Caused by Debris on the Road

Even the most careful drivers can be taken by surprise and crash due to unexpected debris on the road, especially at night or during rainy weather when visibility is reduced.

Liability for single-vehicle accidents caused by debris on the roadway can lie with other drivers, construction companies, or even state governments, depending on the type of debris.

Accidents Caused by Jaywalking/Failure to Yield

2,551 crashes in Texas in 2023 were caused by a pedestrian failing to yield the right of way to a vehicle. Just last month, two pedestrians were killed while illegally crossing Loop 410.

While drivers must be careful and yield the right of way to pedestrians when appropriate, pedestrians have an equally important responsibility to follow all crossing laws and yield the right of way to drivers when appropriate. Accidents can be the fault of the pedestrian.

Accidents Caused by Poorly Maintained Roads

Potholes and other road conditions caused by lack of maintenance can and do cause serious single-vehicle accidents.

A State, local, or city government entity can be responsible for accidents caused by poorly maintained roads, though bringing a claim against the government is notoriously difficult.

Regardless of the type, it can be difficult to prove that a single-vehicle accident wasn’t your fault. An experienced car accident lawyer can help you find out if you have grounds for a claim, what you need to prove third-party liability, and the next steps to take to secure your claim, all for free.
