Guardrail Accidents in San Antonio

You drive by miles of guardrails every day when you go to work and you probably never give them a second thought. But what happens if you hit a guardrail in Texas?

Why Guardrail Accidents Happen

If guardrails are supposed to protect vehicles on the road, then why do guardrail accidents happen? Well, there can be multiple reasons why a guardrail may actually make an accident worse or sometimes even cause an accident, but the most common reasons are:

  • Poor Maintenance – most of the guardrails across the country are pretty old. Improper maintenance can lead to defects that cause the guardrail not to carry the impact the way it should, causing them to snap or bend, leading to serious injury.
  • Faulty Design – A famous trial in 2012 found that Trinity Industries Inc., which was a Dallas-based company that made most of the guardrails across the country, changed their design without notifying the Federal Highway Administration. This change led to the rails being deficient and caused a man to lose both of his legs in an accident.
  • Improper Installation – Sometimes, the company that installs the guardrails may do so improperly, causing extreme injuries. Many fatal guardrail accidents happened because the construction crew that installed them did so at an improper height. Height is critical in safe installation because it affects where the vehicle is impacted.

Can I Leave If I Hit a Guardrail in Texas?

No, you can’t. If you cause property damage in an accident, you have to notify the police. However, if you strike a guardrail at night on an interstate highway, as in the above case, do not exit your vehicle. Turn on your hazards, move to the shoulder or median, and call the police. Stepping out of your vehicle could result in a serious accident, like in the above case.

What If I Hit a Guardrail, and It Wasn’t My Fault?

If another driver hits your vehicle and knocks you into a guardrail, you could be entitled to compensation, especially if you were injured.
